A Raffle Fundraiser for Activate Good!

This page outlines the Official Rules for Activate Good’s Photos for Good raffle occurring between now and October 23, 2021. To participate, purchase raffle entries here.

Entering to win:

  • Entries may be purchased by any legal resident of the state of North Carolina who is age 18 and over, including any persons currently affiliated with or not affiliated with Activate Good. 
  • Entries can only be purchased online at https://go.rallyup.com/activategood2021.
  • The price for entries begins at $10 for 10 entries. Other increments can be purchased at additional price levels. Any number of entries may be purchased.
  • The prizes are a Galaxy Tab A7, 32GB, Silver tablet; (2) a 30-
    minute photography session with Amy Stern Photography
    (headshot
    session in studio with one digital image); and (3) a football ticket and
    parking pass package for the NC State vs. UNC game on November
    26, 2021.
  • Entrants must supply name, mailing address, email, and phone number when purchasing entries to ensure we can contact winners and transfer the prizes to them.
  • Online entries will receive a receipt with raffle numbers via email (please be sure your email is spelled correctly). Entrants should keep this information.
  • The sale of entries ends on Saturday, October 23, 2021 at 5:00 PM.
  • All proceeds will support Activate Good, a 501(c)(3) non-profit organization. Raffle entries are NOT considered tax-deductible donations by the IRS.
  • Entries are non-refundable.

Selection and Notification of Winners:

  • The winners will be selected at random, automatically, by our raffle software, RallyUp. Activate Good will have no control or influence over winner selection.
  • Entrants do not need to be present to win. There will be three winners initially selected. The winners will be notified by phone and email according to the contact information provided to Activate Good at the time of entry. In the event a winner cannot be contacted, fails to respond within 7 calendar days, fails to otherwise qualify for a prize and/or declines a prize, an alternate winner will be selected. If not claimed within 7 calendar days of notification, a winner designee will forfeit any rights to the prizes and the same will be awarded to an alternate winner. The right to take possession of a prize through the winning entry is neither assignable nor transferable.

Prizes are subject to the following official prize details and restrictions:

  • Prizes will be emailed to the winner or mailed anywhere in the continental United States. No shipping outside of the continental United States under any circumstances.
  • All prizes must be claimed within 7 days of notification. If the winner does not claim a prize within 7 calendar days, an alternate winner will be drawn. Any unclaimed prizes will be held for future Activate Good initiatives.
  • There may be federal, state and/or local tax consequences of winning a prize in the Raffle. Any and all taxes are the sole responsibility of the winners. Entrants are advised to consult their own tax advisors with respect to tax liabilities that may arise from winning a prize. Activate Good may file an IRS Form 1099 MISC with the Internal Revenue Service reporting the value of the prizes as income to the winners. Prior to receipt of the prizes and no later than December 31, 2021, winners may be required to provide Activate Good with a completed and signed IRS Form W-9, Form 5754 or similar tax form (provided by Activate Good) for tax withholding purposes.

Full Rules and Regulations

The following rules and regulations, as supplemented above (the “Official Rules”), shall govern the raffle concerned hereby in all respects and all parties thereto involved. By purchasing a ticket, each entrant acknowledges and agrees that such entrant was provided these Official Rules, has reviewed and understands the Official Rules, and agrees to be bound by these Official Rules in all respects.

  • Entries may be purchased by any legal resident of the state of North Carolina who is age 18 and over, including any persons currently affiliated with or not affiliated with Activate Good.
  • The value of the prizes is based on the fair market value of the prize prizes or suggested value of the prizes as supplied by the prize suppliers, as determined on or about the date of the drawing. The value of each prize will not be more than $500.
  • There is no limit to the number of entries an individual may purchase.
  • Entries must be filled out in the name of a single individual.
  • Entries are only available for sale online.
  • Entries are non-refundable.
  • Entry sales will end at 5:00 PM on Saturday, October 23, 2021.
  • The winners will be selected at a random drawing automated by our raffle software, RallyUp. Entrants do not need to be present to win. The winners will be notified by phone and email according to the contact information provided to Activate Good at the time of entry. In the event a winner cannot be contacted, fails to respond within 7 calendar days, fails to otherwise qualify for the prizes and/or declines the prizes, an alternate winner will be selected. If not claimed within 7 calendar days of notification, a winner designee will forfeit any rights to a prize and the same will be awarded to an alternate winner. The right to take possession of a prize through the winning entry is neither assignable nor transferable.
  • Winners are responsible for all applicable local, state and federal taxes. Activate Good may file an IRS Form 1099 MISC with the Internal Revenue Service reporting the value of the prize as income to the winners. Prior to receipt of the prize and no later than December 31, 2021, the winners will promptly provide Activate Good with a completed and signed IRS Form W-9 and Form W-2G (and any other necessary documents) upon request by Activate Good. Depending on a winner’s particular tax situation, any and all winnings may be subject to regular gambling withholding as stipulated by the IRS and may be be paid by the winner. Activate Good assumes no responsibility for the winner’s tax obligations and suggests you consult your tax advisor. This offer is void where prohibited by law and all federal, state and local laws and regulations apply.
  • By receipt of a prize, the winner agrees to release and hold harmless Activate Good, advertising/promotion agencies, prize suppliers, and each such company’s officers, directors, employees, contractors, and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the raffle or receipt or use or misuse of any prize.
  • Activate Good reserves the right to cancel, suspend and/or modify the raffle, or any part of it, if any fraud, technical failures or any other factor beyond Activate Good’s reasonable control impairs the integrity or proper functioning of the raffle, as determined by the organization in its sole discretion. Activate Good reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the raffle process or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the raffle may be a violation of criminal and civil law, and, should such an attempt be made, Activate Good reserves the right to seek damages from any such person to the fullest extent permitted by law. Activate Good’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
  • The Released Parties are not responsible for:
    1. any incorrect or inaccurate information, whether caused by raffle purchasers, printing or software errors or by any of the programming associated with or utilized in the raffle;
    2. technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or hard/software;
    3. unauthorized human intervention in any part of the raffle process;
    4. technical or human error which may occur in the administration of the raffle or the processing of raffle ticket purchases; or
    5. any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from raffle purchaser’s participation in the raffle or receipt or use or misuse of any prize. If for any reason a raffle ticket is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, a ticket purchaser’s sole remedy is another ticket in the raffle, provided that if it is not possible to award another ticket due to discontinuance of the raffle, or any part of it, for any reason, Activate Good, at its discretion, may elect to hold a random drawing from among all eligible raffle ticket stubs up to the date of discontinuance for the prize offered herein. No more than the stated number of prizes will be awarded. In event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed the organization reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un- awarded, eligible prize claims.
  • EXCEPT WHERE PROHIBITED, RAFFLE PURCHASERS ACKNOWLEDGE AND AGREE THAT THE PRIZES WERE PROVIDED TO ACTIVATE GOOD BY  THIRD-PARTY PRIZE SUPPLIERS THAT ARE A RELEASED PARTY HEREUNDER AND THAT ACTIVATE GOOD HAS NO KNOWLEDGE OF OR EXPERTISE RELATED TO THE PRIZES AND THUS CANNOT ASSESS THE CONDITION, USABILITY OR ANY OTHER ASPECT OF THE PRIZE.  THUS, EACH PRIZE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND.  NO PARTY HEREIN INVOLVED (INCLUDING ALL RELEASED PARTIES) MAKES ANY REPRESENTATION OR EXTENDS ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, TO ANOTHER PARTY WITH RESPECT TO THE PRIZES OR OTHER SUBJECT MATTER OF THESE OFFICIAL RULES AND HEREBY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT WITH RESPECT TO ANY AND ALL OF THE FOREGOING. EACH PARTY HERETO (INCLUDING, BUT NOT LIMITED TO, ALL RELEASED PARTIES) HEREBY DISCLAIMS ANY REPRESENTATION OR WARRANTY THAT THE PRIZES SHALL BE IN ANY PARTICULAR CONDITION, USEABLE, USEFUL OR WITH (OR WITHOUT) ANY PARTICULAR (OR GENERAL) DAMAGE OR DEFECT.
  • These Official Rules constitute all of the rules and regulations, other than any applicable federal, state, or local law applicable hereto, as well as all understandings and agreements governing the raffle. There is no prior or other understandings or agreements, whether oral or written, between the raffle purchasers and any Released Party.
  • Except where prohibited, raffle purchasers agree that:
    1. any and all disputes, claims and causes of action arising out of or connected with this raffle or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate North Carolina State Court located in Raleigh, NC, U.S.A.;
    2. any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this raffle, but in no event attorneys’ fees; and
    3. under no circumstances will raffle ticket purchasers be permitted to obtain awards for, and hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and club in connection with the raffle, shall be governed by, and construed in accordance with, the laws of the State of North Carolina, U.S.A. without giving effect to any choice of law or conflict of law rules (whether of the State of North Carolina or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of North Carolina.
